Note: Koch (1867) described a species Clubiona saxatilis that has remained a nomen dubium until Thaler (1981) has revised Koch´s type specimen. Thaler concluded that Koch´s Clubiona saxatilis is identical to the species Clubiona dvoraki described by Miller (1943). However, because Koch´s Clubiona saxatilis has been a nomen dubium since its original description and has not been in use, Thaler (1981) retained the younger name Clubiona dvoraki, which was in prevailing usage. In addition, Koch´s Clubiona saxatilis is a junior
primary homonym of Clubiona saxatilis, described by Blackwall (1833) (the currently valid name of which is Coelotes atropos). Thus, Article 57.2 of the Code (ICZN 1999) applies. It cannot be declared a nomen protectum under Article 23.9.1., because (1) the junior homonym has not been in prevailing usage, as most authors have used "dvoraki", and (2) Platnick (2000 ff.) lists at least one use of the senior homonym after 1899. To the best of my knowledge the case has not yet been referred to the Commission, and neither of the two homonymous names is on the List of Available Names in Zoology, thus Articles 57.2.2. and 57.2.3. do not apply. Thus I fully agree with Thaler (1981) and conclude that, unless the case is referred to the Comission in the future, the name coined by Koch is permanently invalid according to Article 57.2. The next available name is Clubiona dvoraki and I regard this name therefore as the valid name for the species.

Note: the only German record of Clubiona hilaris from "Rheinland" in fact is a misidentification of Clubiona dvoraki (see Thaler 1981). The true Clubiona hilaris has not yet been recorded from Germany.

This species is very rare in Germany. Most German records date from the beginning of the 20th century and might in fact refer to other species of the genus.
